Processing activities of the Controller
One of the principles of processing of personal data is the principle of purpose limitation. Under this principle, personal data may be collected only for a specified, explicit and legitimate purpose and may not be further processed in a manner that is incompatible with that purpose.
The processing of personal data should be closely linked to the purpose of the processing of personal data, in particular as regards the list or scope of the personal data processed, which should be necessary for the purpose to be achieved by processing the personal data concerned. It is not appropriate for the list or scope of personal data to be extended artificially or subsequently in relation to the purpose. Where the purpose and the list or scope of personal data are laid down by law, they must be respected; where the list or scope of the personal data processed is determined by the controller, the controller should take care not to extend it unnecessarily beyond the purpose.
The Personal Data Protection Act lays down the obligation of the controller to provide the data subject with information on the purpose of the processing of personal data for which his or her personal data are intended, including where the personal data are not obtained directly from the data subject. This information must be provided to the data subject at the latest when his or her personal data are obtained, or sufficiently in advance, clearly and comprehensibly and in such a way that the data subject can genuinely acquaint himself or herself with the information and understand it.

Rights of the data subject
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter the “GDPR”) and Act No. 18/2018 Coll. on Personal Data Protection and amending and supplementing certain acts, as amended (hereinafter the “Act”) guarantee you, as a data subject, the following rights:
a) the right of the Data Subject of access to personal data, which comprises:
- the right to obtain from the Controller confirmation as to whether or not personal data concerning the Data Subject are being processed;
- where the personal data of the Data Subject are being processed, the right to obtain access to the personal data processed and the right to obtain the following information:
– information on the purposes of the processing;
– information on the categories of personal data concerned;
– information on the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;

- the right to be provided with a copy of the personal data undergoing processing, subject, however, to the condition that the right to be provided with a copy of the personal data processed must not adversely affect the rights and freedoms of others;
The right of the Data Subject of access to personal data essentially means that the Data Subject has the right to obtain from us confirmation as to whether or not personal data concerning him or her are being processed and, where that is the case, has the right to obtain access to those personal data. At the request of the Data Subject, we will provide a copy of the personal data undergoing processing. For any further copies requested by the Data Subject, we may charge a reasonable fee based on administrative costs. Where the Data Subject has made the request by electronic means, the information will be provided in a commonly used electronic form, unless otherwise requested by the Data Subject. The information must be provided immediately, at the latest within 1 month. We have the right to extend the period for handling the request by a further 2 months where the request is complex or frequent. However, the Data Subject must be informed of the reason for extending the handling period within 1 month. In the case of an unfounded or excessively frequent request, we have the right to charge a fee reasonable in relation to the costs or to refuse the request. We must explain the reason for the refusal and the right of the data subject to lodge a complaint with the supervisory authority.

The Data Subject has the right to have incomplete personal data completed, including by means of providing a supplementary statement.
c) the right of the Data Subject to erasure of personal data (the so-called right “to be forgotten”), which comprises:
- the right to obtain from the Controller the erasure of personal data concerning the Data Subject without undue delay where one of the following grounds applies:
– the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;

whereby the right to erasure of personal data comprising the rights under Article 17(1) and (2) of the Regulation [i.e. comprising the rights under (i) and (ii) of this letter c) of point J. of this document] shall not arise where the processing of personal data is necessary:
1. for exercising the right of freedom of expression and information;
2. for compliance with a legal obligation which requires processing under the law of the European Union or the law of a Member State to which the Controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Controller;
3. for reasons of public interest in the area of public health in accordance with Article 9(2)(h) and (i) of the Regulation, as well as Article 9(3) of the Regulation;
4. for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in accordance with Article 89(1) of the Regulation, in so far as the right referred to in Article 17(1) of the Regulation is likely to render impossible or seriously impair the achievement of the objectives of that processing of personal data; or
5. for the establishment, exercise or defence of legal claims;
The right of the Data Subject to erasure of personal data therefore means that we must erase your personal data if (i) they are not necessary for the purposes for which they were collected or otherwise processed, (ii) the processing is unlawful, (iii) you object to the processing and there are no overriding legitimate grounds for the processing, or (iv) we are required to do so by a legal obligation.

– the Data Subject has objected to processing pursuant to Article 21(1) of the Regulation, pending the verification whether the legitimate grounds of the Controller override those of the Data Subject; - the right that, where the processing of personal data has been restricted pursuant to sub-point (i) of this letter d) of point J. of this document, such personal data subject to restricted processing shall, with the exception of storage, be processed only with the consent of the Data Subject or for the establishment, exercise or defence of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or of a Member State;
- the right to be informed in advance of the lifting of the restriction of processing of personal data;
The right of the Data Subject to restriction of processing of personal data means that, until we have resolved any disputed issues concerning the processing of your personal data, we must restrict the processing of your personal data in such a way that we may only store the personal data of the data subject and not further process them.
e) the right of the Data Subject to the fulfilment of the notification obligation towards recipients, which comprises:
- the right to have the Controller communicate any rectification or erasure of personal data or restriction of processing carried out in accordance with Article 16, Article 17(1) and Article 18 of the Regulation to each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort;
- the right to have the Controller inform the Data Subject about those recipients if the Data Subject requests it;
The right of the Data Subject to the fulfilment of the notification obligation towards recipients means the obligation of the Controller to communicate to each recipient to whom it has disclosed the personal data of the Data Subject any rectification and erasure of personal data or restriction of their processing. The only case in which the Controller does not have this obligation is where such communication is impossible for objective reasons or involves disproportionate effort.
f) the right of the Data Subject to portability of personal data, which comprises:
- the right to receive the personal data concerning the Data Subject which he or she has provided to the Controller in a structured, commonly used and machine-readable format and the right to transmit those data to another controller without hindrance from the Controller, where:
– the processing is based on the consent of the Data Subject pursuant to Article 6(1)(a) of the Regulation or Article 9(2)(a) of the Regulation, or on a contract pursuant to Article 6(1)(b) of the Regulation, and at the same time;
– the processing is carried out by automated means, and at the same time;
– the right to receive the personal data in a structured, commonly used and machine-readable format and the right to transmit those data to another controller without hindrance from the Controller will not adversely affect the rights and freedoms of others; - the right to have the personal data transmitted directly from one controller to another controller, where technically feasible;
The right to data portability means that you have the right to receive from us your personal data which you have previously provided to us in a structured, commonly used and machine-readable format and you have the right to request that we transmit your personal data to another controller, subject to the statutory conditions being met; the exercise of this right is without prejudice to your right to erasure of personal data. However, the right to portability applies only to personal data which we have obtained from you on the basis of a contract to which you are a party.
g) the right of the Data Subject to object, which comprises:
- the right to object at any time, on grounds relating to the particular situation of the Data Subject, to the processing of personal data concerning him or her which is carried out on the basis of Article 6(1)(e) or (f) of the Regulation, including objecting to profiling based on those provisions of the Regulation;
- [in the event of exercise of the right to object at any time, on grounds relating to the particular situation of the Data Subject, to the processing of personal data concerning him or her which is carried out on the basis of Article 6(1)(e) or (f) of the Regulation, including objecting to profiling based on those provisions of the Regulation] the right to have the Controller no longer process the personal data of the Data Subject unless it demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the Data Subject, or grounds for the establishment, exercise or defence of legal claims;
- the right to object at any time to the processing of personal data concerning the Data Subject for direct marketing purposes, including profiling to the extent that it is related to direct marketing; whereby, where the Data Subject objects to the processing of personal data for direct marketing purposes, the personal data shall no longer be processed for such purposes;

The right of the Data Subject to object therefore means that, as a Data Subject, you may object to the processing of your personal data which we process for direct marketing purposes or on legitimate grounds.
